RELEASE AND AGREEMENT

KNOW ALL MEN BY THESE PRESENTS,I, ______________________, the undersigned in consideration of my participation, as a driver or pitman, in the Demolition Derby sponsored by the Roughrider Commission, a non-profit corporation, do hereby release said Roughrider Commission, a non-profit corporation, their successors and assignees, and all other persons firms and corporations who or which are or may be connected with the promotion, operations or the supervision of said Demolition Derby, or who or which may furnish any grounds, stands, vehicles, character, which I, my heirs, executors, administrators and assignees may have arising out of, by reason of, or in connection with my participation in such Demolition Derby to be held on July 4, 2008.

I acknowledge that I am familiar with said contest or event and understand fully the dangers and hazards and the risks incident to participating therein and I do hereby agree to, and do hereby assume, all risks of the same, both ordinary and extraordinary, whether or not caused negligence or gross negligence, and do agree to indemnify and hold harmless the parties hereby released from any and all damages, suits, claims or demands which I may have arising therefrom.

I further acknowledge and understand that the parties hereby released do not in any way guarantee the construction of any equipment or facilities to be used in such event, or any vehicles to be used, nor do they guarantee safe use of any and all such vehicles, facilities, and equipment or other materials used in connection with said Demolition Derby, and I do hereby agree to use the same and participate in said event entirely on my own risk.
